TERMS AND CONDITIONS

1.1 Family Competitions (‘Promoter’, ‘our(s)’) operates various competitions resulting in the allocation of prizes in accordance with these terms and conditions on the website (‘Prize’ or ‘Prizes’) http://familycompetitions.com (the ‘Website’) – (each and all such competitions being referred to herein respectively as the ‘Competition’ or ‘Competitions’).

1.2 Competitions are open to persons aged 18 or over anywhere in the world. Employees of the Promoter or any person connected with the Promoter (through family, professional or commercial association) are restricted from participating in the Competition.

1.3 The Promoter reserves the right to close a Customer’s account at any time if they feel the Customer is abusing the services, being abusive to other Customers or staff, or they have the belief that it is not genuinely the Customer that is entering.

1.4 The Promoter reserves the right to refuse a Customer’s Entry at the Promoter’s own discretion.

1.5 These terms and conditions apply to Competitions operated by Family Competitions.

2.1 By entering a Competition, the entrant (‘Entrant’, ‘you’, ‘your(s)’ and/or ‘Customer’) will be deemed to have legal capacity to do so, will have read and understood these terms and conditions, and will be bound by them and by any other requirements set out in any of the Promoter’s related promotional material.

2.2 Competitions are governed by U.K. law, and all matters or disputes relating to the Competition will be dealt with and resolved under U.K. Law. The Courts of the United Kingdom shall have exclusive jurisdiction.

2.3 By participating in a Competition online via the Website, you confirm that you are not breaching any laws in your country of residence regarding the legality of entering our Competitions. The Promoter will not be held responsible for any Entrant entering any of our Competitions unlawfully. If in doubt, you should immediately leave the Website and check with the relevant authorities in your country.

3.1 Competitions may be entered via the Website. Multiple Competitions may be operated simultaneously by the Promoter, and each Competition will have a specific Prize.

3.2 Availability and pricing of Competitions are at the discretion of the Promoter and will be specified at the point of sale on the Website. Raffle tickets can be purchased using card payment or selected cryptocurrencies. There is no requirement to pay to enter any Competition, as each Competition has a free entry route available.

3.3 In order to enter a Competition, you will need to register an account with us. You can register an account online. To register an account online, you will be asked to provide an email address or sign in via a social media account, such as Facebook, Twitter, or Gmail (‘Social Media Account’).

3.4 When entering a Competition online via the Website, you must follow the on-screen instructions to: (a) Select the Competition you wish to enter and, when ready, purchase your raffle ticket(s) to the Competition (‘Tickets’) using card payment or selected cryptocurrencies. (b) Provide your contact and payment details. You will need to check your details carefully and tick the declaration, confirming you have read and understood the Competition terms and conditions. (c) Once you have purchased your Tickets and your payment has cleared, we will contact you by email to confirm your entry into the Competition. You will not be deemed entered into the Competition until we confirm your entry, which can be verified in your account when you log in (any such entry referred to herein as an ‘Entry’ or ‘Entries’).

3.5 To the extent permitted by applicable law, all Entries become the Promoter’s property and will not be returned.

3.6 Each Competition closes when the last number is taken or the date and time has completed; no more Entries will be accepted after this point.

3.7 All Entrants (including those entering for free) must create an account prior to entering and supply an email address to proceed in the Competition.

4.1 Each Competition will run for a specified period. Please see each Competition for details of start and end times and dates.

5.1 The Promoter reserves the right to refuse a registration for any reason whatsoever at its sole and absolute discretion (including, without limitation, a person applying to participate in a Family Competitions draw not satisfying the requirements set out in rule 5.2 below).

5.2 A person applying to participate in a Family Competitions draw must satisfy the following requirements: (a) The person must be 18 or over. (b) The person must provide valid debit card details or select cryptocurrency payment options as specified. (c) The card must be linked to a bank account (or building society)  for which they are an authorized user. This bank or building society account must not be a joint account and must be held in the applicant’s own name. (d) The card referred to in (c) above must not have been reported as lost or stolen and cannot be used to participate in more than one Family Competitions draw. (e) The card referred to in (c) above must bear the applicant’s name and match the applicant’s details supplied, including (without limitation) the applicant’s billing address.

5.3 The Promoter may carry out checks and/or request information from time to time from Entrants during registration and/or from participants after registration to verify that Entrants and participants, as well as the information and details supplied by them, meet the criteria set out in this rule 5. These checks may include (without limitation) credit reference checks. No Prizes will be given to a participant if the criteria set out in this rule 5 are not met, or if they are ineligible to participate for any reason whatsoever.

5.4 In carrying out the checks referred in rule 5.3 above, the information and details you may have provided to the Promoter may be disclosed to a credit reference agency to perform an identity check. This may be a verification footprint rather than a credit footprint. The checks look only at the existence of the name, address, and date of birth with lenders rather than any current or previous credit information. This will leave a soft footprint on your credit file for 12 months. These checks will also be conducted when a postal claim is made and, in the event our electronic checks cannot verify your information and details, the Promoter may request physical documentation such as a driving licence or passport to prove eligibility to participate in a prize draw.

5.5 The Promoter and/or third parties on its behalf may also carry out checks to verify that an Entrant is entitled to participate and has enough funds to purchase raffle tickets.

6.1 The prize for each competition is as described on the competition entry page on the Website (the “Prize”). Details of the Prize are, to the best of the Promoter’s knowledge, information, and belief, correct.

6.2 Prizes are subject to availability. The Promoter reserves the right to substitute the Prize with a prize of equal or greater value. If any details of the Prize change, the Promoter will endeavour to update the Website as soon as reasonably possible.

6.3 The Promoter makes no representations and gives no warranties about the Prize, its value, its condition, or any other information provided on the Website. The Promoter makes no representations and gives no warranties that the information provided on the Website is accurate, complete, or up to date.

6.3.1 If the Prize is a vehicle: (a) The Promoter will, unless otherwise stated, ensure it comes with a valid MOT (if required); (b) No insurance is included with the Prize and it is the Winner’s responsibility to ensure the vehicle is adequately insured prior to taking it on public roads (if it is legal to do so); (c) The Promoter has no responsibility for the Prize(s) once it has been delivered/collected. The Winner is solely responsible for complying with all relevant laws and regulations relating to the vehicle, its operation, and ensuring they operate it in a safe and responsible manner; (d) No vehicle/road tax is included; (e) The Winner is solely responsible for ensuring they have all necessary safety equipment and clothing (for example, helmets, boots, and gloves) and for wearing them whilst operating the vehicle.

6.3.2 The Promoter guarantees that all tech prizes are brand new for each competition but cannot guarantee Prizes will have a warranty for any breakages after they are handed over to the Winner.

6.4 The Prize may be supplied by a third-party supplier (the “Supplier”). Details of the Supplier (if any) will be provided on the Website.

6.5 The Promoter reserves the right to substitute the Prize for an alternative cash prize (“Cash Prize”) equal to the market value of the Prize as reasonably determined by the Promoter, including any original discounts on price. The Cash Prize value will be displayed on each competition page or available on request. The Prize can be substituted for a Cash Prize in the following circumstances: (a) The Prize, or a reasonable alternative, becomes unavailable; (b) Other circumstances beyond the reasonable control of the Promoter make it necessary to do so; (c) The Winner opts for a Cash Prize instead of the Prize.

6.6 If the Winner wishes to take a Cash Prize instead of the vehicle, the Promoter will seek the best price from local traders. Any cash values advertised on the Website are an estimated price and the cash alternative value will be confirmed at the current trade value of the vehicle at the time of the sale. The Promoter may make a reasonable deduction from the sale price to cover the time and administration costs required to undertake the task of securing the best price for the Winner. The Winner is under no obligation to accept the cash alternative if they disagree with the amount of the cash alternative. They can accept the vehicle as the Prize and may then sell it privately.

6.7 The Prize is not negotiable or transferable.

6.8 Winners are responsible for any duty and/or tax in relation to their receipt of the Prize.

7.1 The decision of the Promoter is final and no correspondence or discussion will be entered into.

7.2 The Promoter will contact the Winner personally after the competition, using the telephone number or email address provided with the entry. It is the Entrant’s responsibility to ensure that their personal information is kept up to date. If the Winner cannot be contacted, is not available, or does not claim the Prize within 21 days of the competition date, the Promoter will re-run the competition and will select an alternate Winner. The alternate Winner shall have 21 days from notification to accept the Prize. This process shall continue until a Winner accepts the Prize. The original Winner(s) will have no claim to any Prize in this scenario.

7.3. All Winners are revealed and will be required to provide photographs and/or pose for photographs and videos, which may be used in future marketing and public relations by the Promoter in connection with the Competition and in identifying them as a winner of a Competition.

8.1. Winners must claim the Prize personally. The Prize may not be claimed by a third party on their behalf. Details of how the Prize will be delivered to you (or made available for collection) are published on the Website, or available on request.

8.2. If your personal details, including contact information, changes at any time you should notify the Promoter as soon as reasonably possible. Notifications should be sent to the Promoter via email to info@familycompetitions.com

8.3. Any cash Prize will be transferred directly to the Winners nominated bank account. The Winner must provide evidence that it is the sole or joint beneficiary of the bank account. Failure to do so within 14 days will result in disqualification from the competition and the Winner forfeiting the Prize. In such circumstances, the Promoter reserves the right to re-run the competition and offer the Prize to another Winner.

8.4. The Promoter does not accept any responsibility for and is not liable to pay any compensation, if you are unable to take up the Prize.

8.5. If the Prize is a vehicle and the Winner has completed all eligibility checks, the Prize will be transferred to the Winner by the Promoter using the V5 for each vehicle. This must be completed before the vehicle is handed over.

8.6. Delivery of a Prize will only be to an address within the UK. This includes physical prizes, such as Cars or Tech Goods.
